WASHINGTON COUNTY, Ark. — One month before the jury trial for Jason Dunigan is set to begin, Washington County prosecutors filed a notice on May 20 that says they are waiving the possibility for the death penalty in Dunigan's capital murder case.

Ahead of prosecutors filing the notice, lawyers representing Dunigan asked for a motion of continuance on May 8 for more time to collect witnesses and evidence since the state was still planning to seek the death penalty.

However, the trial is still expected to begin on June 23, 2025, at 8:30 a.m. after several delays.

With the death penalty now off the table, Dunigan could only face life imprisonment without parole for the death of his wife, 36-year-old Amber Dunigan.
