WEST VIRGINIA (WCHS) — An attorney in a lawsuit that sought to restore jobs at the National Institute of Occupational Safety and Health in Morgantown said it does not appear all of the programs and services are functioning as the judge ordered.

Sam Brown Petsonk, an attorney representing a southern West Virginia coal miner in a lawsuit against the U.S. Department of Health and Human Services and secretary Robert F. Kennedy Jr., said attorneys in the case are considering their options after it looks like the federal government hasn’t followed through with the court ordered deadline to resume the programs.

“We have concerns, it does not appear all the NIOSH programs and services mandated by the Mine Act are functioning as they were before the RIFs,” he told Eyewitness News. “We are cons
