DEDHAM, Mass. (WLNE) — Judge Beverly Cannone has denied a motion for a mistrial by Karen Read’s defense team.

Read’s attorney Robert Alessi called for the mistrial because John O’Keefe’s arm was never swabbed for DNA, only his clothing.

This comes after special prosecutor Hank Brennan brought up DNA in his cross examination of the dog bite expert on the stand Tuesday.

Alessi claims Brennan must have “admissible evidence” to bring up DNA.

After a short break for discussion, the judge returned to the bench with the jury dismissed and denied the defense’s motion.

Earlier, prosecutors had attempted to block testimony from Dr. Marie Russell, an emergency physician and forensic pathologist.

Judge Cannone ruled her testimony was allowed.
