ATLANTA — A federal judge has dismissed the charges against Sung Kim , an ex-Atlanta Police Department officer who was charged in the 2019 shooting of Jimmy Atchison during a law enforcement operation.

Kim was originally indicted in December 2022, and faced charges including felony murder, aggravated assault, involuntary manslaughter and violation of oath. Judge Michael L. Brown found he was immune under federal supremacy principles to some of his charges, as he was acting as a deputized federal officer at the time of the shooting. The judge determined his other charges were barred under self-defense immunity principles.

The Georgia NAACP has called for Fulton County District Attorney Fani Willis to appeal the ruling, calling it a "deeply troubling decision" in a statement.
