DENVER (KDVR) — A class action lawsuit filed by neighbors over "noxious odors" allegedly released by a nearby Nestle Purina pet food plant was voluntarily dismissed last month.

The lawsuit was filed in 2024 by a pair of residents in the area of the Purina plant, which is in the Elyria Swansea neighborhood next to Interstate 70 and just blocks away from nearby homes.

Plaintiffs Robert Fields and Lorena Ortiz claimed their homes had been "physically invaded by noxious odors" and that more than 50 households had contacted their counsel about the odor, which they argued affected over 2,000 homes.
