BAKERSFIELD, Calif. (KGET) -- The mother of the 15-year-old boy shot and killed at The Marketplace in November has filed a claim against the City of Bakersfield.

The claim alleges the Bakersfield Police Department received reports of violence at The Marketplace an hour prior to the shooting but failed to respond properly.

The claim also accused the police department of not providing enough security, such as lack of patrols and police presence in the area, despite the area being known for “youth gatherings, violence and previous disturbances.”

BPD’s failure to intervene led to and worsened the fatal shooting of Prince Michael Banner, according to the claim.

Banner’s mother is claiming a total of $15 million from the city.
