BAKERSFIELD, Calif. (KGET) -- There was a point while assaulting his 74-year-old roommate, stomping on his head and neck, when Jason Garibay paused and could have gotten help, he told police. He could have listened to his roommate's pleas to stop.

He ignored him instead.

Garibay, 30, told police he resumed stomping on the head of Domingo Trevino, killing him.

"Garibay advised he killed the victim because they didn't get along and it was time for him to die," an investigator wrote in a probable cause declaration released Thursday.

Charged with murder and assault on an elder adult, Garibay is being held without bail. A preliminary hearing is scheduled later this month.

The assault happened Monday at an apartment on South Williams Street. Police called to the scene found Trevino dead.
