SPARTANBURG COUNTY, S.C. —

The family of Kolson Elliott, 16, has reached a settlement with the South Carolina Department of Transportation after a deadly crash.

The crash happened on April 27, 2021, on Drayton Road.

According to the lawsuit, Elliott's car went off the right side of the road when he veered to avoid a collision. The car went over an embankment and into Lawsons Fork Creek.

The lawsuit said Elliott drowned inside his vehicle in the creek.

The lawsuit stated that the bridge over the river did not have guardrails to protect from a vehicle going down the embankment.

Court documents show SCDOT agreed to pay $350,000 to resolve the lawsuit.

Elliott was a student at Boiling Springs High School.
