NILES, Mich. (WNDU) - The Buchanan man accused of hitting and killing a Berrien County Road Department worker while driving drunk nearly three years ago could soon be facing trial.

According to our reporting partners at The Herald-Palladium , the Michigan Court of Appeals denied 37-year-old Taylor Johnson’s appeal this week.

Prosecutors say the case against Johnson should now go back on the trial schedule docket, but the defense attorney says her office is still assessing whether they will appeal the Court of Appeals decision.

The case has been delayed several times since the 2022 incident .

Johnson is charged with driving while intoxicated causing death after police say he hit and killed 57-year-old William “Mack” Isom back on July 20, 2022. It happened on Red Bud Trail in Oronoko
