A Plymouth man accused of raping a woman has been found not guilty. David Munday, 33, denied the single charge of rape and was standing trial at Plymouth Crown Court.

The trial heard prosecution claims that he took advantage of the woman after she had drunk up to ten cocktails during a six-hour period with a female friend.

Munday, of Ferndale Avenue, said the pair did have sex but that she was not as drunk as she claimed and was a willing participant.

The issue for the jury during the three-day trial was whether the alleged victim had given her consent. The prosecution said she was incapable of doing so, because of her intoxicated state.
