FORT WAYNE, Ind. (WPTA) - The son of a woman shot and killed by Fort Wayne police earlier this year has filed a wrongful death lawsuit.
He’s suing the department and the officers involved.
The Allen County Prosecutor cleared the officers of any wrongdoing yesterday.
In the lawsuit, Patricia Hepworth’s son says their actions were “reckless, willful, and deliberately indifferent” to her rights.
It happened in January when officers tried to get ahold of Hepworth because she violated her parole.
Hepworth was found guilty of attempted murder and arson.
She was sentenced to 50 years in prison in 2000.
Hepworth was suffering from a mental health crisis and was armed with a knife.
Police say she barricaded herself inside her apartment, but the lawsuit claims her door was open.
