AUSTIN, Texas — A new law in Texas is set to take effect on Monday, Sept. 1 that would ban certain vape products.
During the 2025 Legislative Session, state lawmakers passed Senate Bill 2024. The ban will impact businesses from selling vapes that contain THC or any other substances made with hemp like Delta-8.
SB 2024 also includes penalties for businesses that continue to market or sell these products, which would make it a Class A misdemeanor.
Sellers could face up to a year in jail and up to $4,000 in fines.
Banning THC outright in Texas has been a priority of Lt. Gov. Dan Patrick, as he and other Texas lawmakers have expressed concern that products are being marketed and sold to minors, with little accountability.
