WACO, Texas — Immigration and Customs Enforcement (ICE) has filed an appeal of a bond that would have allowed the release of a Waco man the department has been holding in custody.

Noe Guerrero was arrested by ICE in Waco in July for allegedly failing to carry proper immigration documents. Charges against Guerrero were dropped days later after it was ruled he did have the proper documents in his vehicle, but ICE has continued to keep him detained .

Immigration Court Judge Billy J. Sapp issued a $5,000 bond to allow for Guerrero's release on Aug. 14, but ICE filed a 10-day stay to keep him in custody while they consider an appeal.

On Aug. 29, the day after the stay was set to end, Guerrero's attorney, Anali Looper, told 6 News ICE filed an appeal and will continue to detain Guerrero.
