The first protester to be arrested for chalking at the Pulse memorial crosswalk is out of jail after a judge found the Florida Highway Patrol had no probable cause to arrest him for his actions Friday night.

Suarez said he didn’t even see the signs saying "Defacing the Roadway is Prohibited" when he put chalk on his shoes and walked onto the crosswalk that had been painted in rainbow colors before FDOT first erased them 10 days ago.

Relieved to have been let out of jail without needing to post a bond, Suarez returned to Pulse Saturday afternoon.
