Network to refile amended antitrust suit after judge calls initial filing technically flawed.

A U.S. District Judge on Thursday dismissed an antitrust lawsuit filed by Newsmax against Fox Corporation and Fox News, stating that the complaint was an improper “shotgun complaint.” The dismissal, however, was “without prejudice,” allowing Newsmax to refile the lawsuit with a corrected complaint.

In her decision, U.S. District Judge Aileen Cannon, who President Donald Trump appointed, found that Newsmax’s five-count lawsuit was technically flawed because each successive count incorporated the allegations of the counts before it.
