SUN PRAIRIE, Wis. (WKOW) — On Friday, a federal judge made the decision to deny the preliminary injunction challenging Wisconsin's new vape ban law. The new state law banning smoke shops from selling non-FDA-approved vaping devices took effect on September 1. Currently, only menthol and tobacco flavors are allowed.

In July, the Wisconsin trade organization WiscoFAST filed a lawsuit against the Department of Revenue to halt the ban. The group argues that the law unfairly encroaches on the FDA's role in regulating these products.

"People that are trying to get off cigarettes came and use this as a safer alternative, and now they don't have that option, and that right there breaks my heart, because I know how many people I've helped," said Kayla Arthur of Sun Prairie's M of N Vapors.
