A recent ruling by the Board of Immigration Appeals (BIA) has implications for bond hearings nationwide, according to law groups in Nebraska.

In a decision issued Sept. 5, the BIA stated, “Immigration Judges lack authority to hear bond requests or to grant bond to aliens who are present in the United States without admission.”

The ruling marks a departure from how immigration law has been interpreted for decades, according to local attorneys.

“The millions of people that have been here for possibly decades, now are potentially at risk of being detained and not being released until the end of a deportation proceeding,” said Omaha immigration attorney Larry Jarvis.
