The state Court of Appeals denied a request to hear an appeal filed by a Fayetteville resident who objects to a plan to put a chain supermarket in the village.
The court on Thursday denied Marguerite Ross’ request to hear her appeal. Another appeal Ross filed was denied in 2023.
This marks the last of the appeals filed by Ross opposing the plans to put a Hannaford grocery store at 547 E. Genesee St. That was once an O’Brien & Gere engineering and manufacturing facility.
The grocery store was first proposed to the village in 2019 and approved by officials in 2022.
Ross, who lives near the 30-acre site of the planned store, had filed two lawsuits against the village and the developer, Northwood Real Estate Venture LLC of Fairport.
