BUFFALO, N.Y. — Judge Emilio Colaiacovo has ruled in favor of acting Mayor Chris Scanlon and Fillmore District Common Council member Mitch Nowakowski in their lawsuit against city Comptroller Barbara Miller-Williams.
The city comptroller is now being compelled by the court to go to the bond market for funds approved in the 2025 capital budget.
"No matter how well-intended the Comptroller is, absent any controlling legal authority empowering her to intervene in the budgetary process, her failure to act in this ministerial duty requires this judgment to compel her to act," Colaiacovo said in his ruling.
