A British Columbia man has been sentenced to 28 months in prison for the sexual assault of a woman, who will endure lifelong emotional and physical consequences from the attack. Brendan William John Sullivan, 29, pleaded guilty in August to one count of sexual assault against a victim identified only as R.D., who was 19 at the time of the incident. The sentencing took place in a Chilliwack provincial court last week.
Judge Michael Fortino acknowledged Sullivan's remorse but emphasized the severe impact of his actions on the victim's life. "She will live daily with the pain and discomfort of your offending, both emotionally and physically," Fortino stated. He added that Sullivan would also have to grapple with the shame brought upon himself and his family.
The assault occurred on October 30, 2022, after Sullivan and R.D. met at a nightclub in Chilliwack. After consuming alcohol, they decided to leave together. However, when R.D. learned that Sullivan's home was about 50 kilometers away, she expressed hesitation. In an alleyway near the club, Sullivan suggested they engage in sexual activity, which R.D. repeatedly declined. He then forcibly pushed her against a wall and assaulted her despite her protests.
Sullivan proceeded to have non-consensual intercourse with R.D. for approximately 30 minutes, during which she continued to say no. Fortino noted that when R.D. attempted to call for help, Sullivan covered her mouth and pinned her arms down, preventing her from defending herself. During the assault, R.D. managed to text her friends for help, indicating she was in danger.
One of her friends, upon hearing distressing sounds, entered the alley and witnessed the assault. As the friend intervened, Sullivan claimed the encounter was consensual, but R.D. vehemently denied this, stating, "We are not f—ing friends." The commotion attracted the attention of others nearby, who intervened and restrained Sullivan until police arrived. He continued to assert that the sexual encounter was mutual, although he admitted he did not have R.D.'s verbal consent.
Following the incident, R.D. underwent a forensic examination, which revealed significant physical injuries, including bruises and gravel embedded in her body. In her victim impact statement, R.D. described ongoing physical issues, including urinary stress incontinence and constant pain, as well as severe emotional trauma, including flashbacks and panic attacks.
Sullivan, who had no prior criminal record, was diagnosed with alcohol use disorder and unspecified depressive disorder. A psychological assessment indicated that his alcohol use impaired his judgment and perception of consent. Despite this, a pre-sentence report highlighted support from family and friends, suggesting that the assault was out of character for him.
In addition to his prison sentence, Sullivan has been prohibited from owning firearms or weapons for ten years. His defense team had sought a conditional sentence, citing his low risk of re-offending, but the court ultimately imposed a prison term.
