The onetime restaurant waiter who admitted stealing and writing a flurry of checks to himself and friends was led out the back door of the Charlottesville Circuit Court and taken to jail Thursday after repeatedly failing to meet with a probation officer ahead of his sentencing.

Elijawha Darius Scott, 22, had hoped for an incarceration-free outcome after pleading guilty in July to a felony count of obtaining money by false pretenses. But when his case came before Judge Thomas Padrick, the court heard that Scott had not met the probation officer who was writing the presentence report. That, according to defense attorney Carlos Moreno, affected the crucial document.

“My client failed to meet with probation for his interview,” Moreno told the court. “The report is incomplete.”
