A bipartisan group of former U.S. attorneys is urging a federal appeals court to block what they call a dangerous abuse of executive power.

The former U.S. attorneys argue that President Donald Trump’s move to install Alina Habba as New Jersey’s top federal prosecutor without Senate confirmation violates federal law and threatens the constitutional balance of powers.

The former prosecutors called the administration’s effort to delegate prosecutorial authority to Habba a “lawless” attempt to bypass constitutional and statutory limits on federal appointments .

“Congress did not want neophytes assuming such authority, much less the ‘unfit characters’ feared by the Framers,” the brief states.
