Oregon National Guard members may remain under federal control but cannot be mobilized into federal service in Portland, a three-judge appellate panel said as they placed an administrative hold on the case Wednesday.

The three-judge panel of the 9th U.S. Circuit Court of Appeals issued the temporary hold as they prepare to hear arguments Thursday morning on whether to grant a full hold, or stay, based on the merits of the case.

The administrative stay will maintain President Trump’s federalization of Oregon National Guard members but prohibit their deployment into federal service in Portland, as the federal government has not challenged U.S. District Judge Karin J.
