BAKERSFIELD, Calif. (KGET) -- Misdemeanor DUI charges have been brought against the driver of one of two vehicles that hit and fatally injured a pedestrian who was crossing East California Avenue outside a crosswalk.

A hearing for 31-year-old Timothy Suniga is scheduled next week. He's not in custody.

The crash happened the night of May 9 in the 700 block of East California Avenue.

Anthony Gregory Martinez, 34, was hit by Suniga's vehicle at about 8:53 p.m., coroner's officials said. Another vehicle heading in the same direction also hit him.

He was taken to Kern Medical, where he was pronounced dead within an hour.

Both drivers remained at the scene. Suniga was arrested after an officer determined he was under the influence of alcohol.
