(WHNT) — The Alabama Attorney General's Office has officially replied to former Decatur Police Officer Mac Marquette's appeal to the Alabama Supreme Court.
In August, Marquette asked the state’s high court to consider that he acted in self-defense when he killed Stephen Perkins, nearly two years ago, in an on-duty shooting during a botched truck repossession.
That request through Marquette’s lawyers came after the trial court and the Alabama Court of Criminal Appeals both said there wasn’t sufficient evidence in his court filings to support a self-defense claim. Both courts found that questions about Marquette’s role that night, if he was acting in a law enforcement capacity, would be best resolved in front of a jury.
