J.M. Smucker Co. is suing Trader Joe’s, claiming the chain’s new frozen peanut butter and jelly sandwiches are a knockoff of its Uncrustables.
CNN reports Smucker is accusing the grocery chain of violating its trademark, noting in an Ohio federal lawsuit filed on Oct. 13, the sandwiches have similar pie-like crimp markings on the edges.
In the lawsuit, Smucker also alleges Trader Joe’s boxes are similar to Uncrustables with a blue color scheme, lettering and packaging design showing a bite mark, CNN reports.
“Smucker does not take issue with others in the marketplace selling prepackaged, frozen, thaw-and-eat crustless sandwiches. But it cannot allow others to use Smucker’s valuable intellectual property to make such sales,” Smuckers said.
