Three men in Scotland have agreed to be extradited to Canada to face charges related to the death of Sharif Rahman, an Owen Sound restaurant owner, more than two years ago. The men consented to the extradition request during a hearing at the Edinburgh Sheriff Court on Monday morning.

The case will now be sent to the Scottish Ministers, who will decide whether to proceed with the extradition. The cabinet secretary for justice typically makes this decision and has a two-month timeframe to do so. Although the men have consented to extradition, they still have the option to appeal the decision to the High Court of Justiciary.

Robert Evans Jr., 24, faces a charge of manslaughter. His father, Robert Busby Evans Sr., 48, and uncle, Barry Evans, 55, are each charged with being an accessory after the fact to commit an indictable offense. The charges have not yet been tested in court.

Sharif Rahman, 44, was married and had a young daughter when he was assaulted outside his restaurant, The Curry House, on August 17, 2023. He succumbed to his injuries a week later in a hospital in London, Ontario. The trial is expected to take place in Owen Sound, where the accused will have the opportunity for a preliminary hearing and to choose whether they will be tried in the Ontario Court of Justice or the Superior Court of Justice.

During the extradition proceedings, Sheriff Julius Komorowski noted that it is alleged Robert Evans Jr. punched Rahman outside the restaurant after dining there with his brother and uncle. Barry Evans was reportedly nearby when the incident occurred. Police were called to respond to an “ongoing assault.”

It is alleged that after the assault, Robert Evans Jr. fled the scene until Barry Evans drove up, honked the horn, and shouted, "run, run," allowing him to enter the vehicle. Barry Evans is said to have driven them to a location 40 miles away, rather than to the accommodations he had booked.

Following several phone calls that evening, Robert Busby Evans allegedly learned that his son had assaulted someone. He is accused of arranging a flight for Robert Evans Jr. to the United Kingdom and driving him to the airport, where Robert Evans Jr. departed Canada that same evening. Barry Evans reportedly retrieved his deposit and driver’s license and removed his guest registration from the accommodations he had reserved.

Sharif Rahman was originally from Bangladesh, where he studied economics before earning a master’s degree in international development at the University of Glasgow. He purchased The Curry House in 2015 and was known for hosting fundraising dinners for the Canadian Foodgrains Bank.
