CNN reporter Katelyn Polantz revealed on Monday that former FBI Director James Comey appears to be using President Donald Trump's own words against him in court.

Comey's lawyers filed a motion to dismiss Trump's prosecution against Comey because it is a "selective or vindictive prosecution," according to Polantz. In layman's terms, that means the prosecuting team is retaliating against a defendant, which courts have held is a violation of due process rights.

"They're arguing that Donald Trump is the person that said to the Justice Department, 'You must prosecute Jim Comey,' and if that had not happened, this case wouldn't exist," Polantz said.

"One of the things that the defense team writes here is that they say it's smoking gun evidence that Donald Trump has said on social media over and over again how much he hates Jim Comey, and that that is the reason that this case should be dismissed," she continued.

Comey was indicted on two counts of obstruction of justice and lying to Congress about two weeks ago. The indictment came after Trump appointed one of his former defense attorneys, Lindsey Halligan, to the U.S. Attorney's Office for the Eastern District of Virginia, which filed the charges.

Trump also posted on Truth Social that "time is running out" for Attorney General Pam Bondi to charge Comey. That post was supposed to be a direct message to Bondi, according to reports.
