A Tulsa County judge denied resentencing for a woman convicted of murdering her husband more than 40 years ago.
Norma Lumpkin was given a life sentence a year after killing her husband, but asked a judge to release her based on the Oklahoma Survivors' Act.
The judge determined evidence in this case showed the murder of Gilbert Lumpkin was premeditated.
Explaining the judge's decision
The judge says the alleged abuse was not enough to murder Gilbert and there were no police reports, 911 calls or protective orders filed against him.
Based on the evidence, the judge says Gilbert's murder was planned, so Lumpkin's original life sentence stands.
