The City of Rochester has dropped its lawsuit against the property owner of a former Vacuum Oil industrial site along the Genesee River, paving the way for its remediation.

The city’s suit to take control of 5 Flint St., then owned by One Flint St., LLC, was filed in June 2023. The parcel was conveyed to Exxon Mobil in August of the same year.

The city negotiated an arrangement with Exxon Mobil in 2024, resulting in the company applying for the state’s Brownfield Cleanup Program on 5 and 15 Flint St. and agreeing to remediate the city’s Vacuum Oil cleanup site. Part of that agreement was that the city would drop the action to control the properties.
