ADEL, Iowa —

A judge has dismissed evidence in the case of Richard Hoesing, a Perry man accused of killing his wife , Jean Hoesing, in March.

New court records indicate that investigators violated the rights of the 75-year-old by continuing to question him after he requested a lawyer.

The judge also dismissed phone records obtained using a search warrant, which was deemed too vague to seek data from his phone.

Hoesing turned himself in and is charged with first-degree murder in the death of his wife. Court documents say Richard Hoesing told investigators that his wife suffered from bipolar disorder and multiple sclerosis and that he was "putting her out of her misery."
