A Las Cruces nonprofit and two Doña Ana County residents have sued the county in hopes of stalling a massive data center complex proposed in Santa Teresa.

The nonprofit Empowerment Congress of Doña Ana County alleges in the lawsuit the County Commission approved $165 billion in industrial revenue bonds in a 4-1 vote in September without sufficient information, a move that violated county code.

The complaint was filed Oct. 17 in the 3rd Judicial District Court. It comes as data centers nationwide have raised concerns over their heavy use of power and water. But proponents of Project Jupiter — the Santa Teresa development proposed by Austin, Texas-based BorderPlex Digital Assets — tout its potential for boosting the state’s economy.
