CLEVELAND, Ohio — A growing number of federal judges across the country are challenging the U.S. government’s use of automatic immigration detention policies, ordering the release of immigrants who were denied bond hearings under controversial legal interpretations.
In two recent cases — one in Kentucky and another in Cleveland — judges ruled that the U.S. Department of Homeland Security and immigration courts violated detainees’ constitutional rights by denying them the opportunity to argue for release.
The Kentucky ruling was highlighted in the Cleveland judge’s order and has been used in other decisions across the country.
In that case, Balwinder Singh, a longtime Indiana resident and Indian national, was detained by U.S. Immigration and Customs Enforcement in July, despite living in
