Immigration and Customs Enforcement (ICE) has deported a man who a judge said had a “substantial” claim to U.S. citizenship, according to the American Civil Liberties Union (ACLU).
Tricia McLaughlin, an assistant secretary of Homeland Security (DHS), wrote in a statement provided to Newsweek that he was deported before a judge made that order.
“To the media’s chagrin, there was no mistake. This [temporary restraining order] was not served to ICE until after the criminal illegal alien was removed,” she said.
Newsweek has contacted the ACLU of Louisiana, which represented the man, for comment via email.
