Illinois advocates filed a class action lawsuit against federal authorities on Friday over alleged “inhumane” conditions at a Chicago-area federal immigration facility, claiming violations of detainee’s constitutional rights and federal regulations.
The plaintiffs’ lawyers – the MacArthur Justice Centre, the ACLU of Illinois, and the Chicago office of law firm Eimer Stahl – allege that federal authorities have violated the Fifth Amendment Due Process clause by imposing unreasonable conditions of confinement and by violating administrative regulation prohibiting coercion. They further allege a violation of the First Amendment by denying detainees their right to counsel.
