(CNN)– In just days the Supreme Court will hear oral arguments on whether President Trump’s tariff policy is legal.

The case will consider whether the president had the legal authority to impose tariffs by using a law known as the International Emergency Economic Powers Act.

That law gives the president the ability to set tariffs in a national emergency.

The president used that authority to impose tariffs as high as 50% on India and Brazil, and 145% on China earlier this year.

American businesses have paid nearly $90 billion to cover the tariffs being challenged.
