The Alberta Teachers’ Association is expected to deliver an update on Thursday afternoon about possible legal action after the Alberta government shut down the educators’ provincewide strike last week.
Jason Schilling, the head of the Alberta Teachers’ Association, has said the province had other options to resolve bargaining issues with teachers instead of the government passing back-to-work legislation.
It’s not clear what legal options the teachers have, given that the back-to-work bill invoked the Charter’s notwithstanding clause to override teachers’ rights and shield the bill from constitutional challenge.
Schilling says using the notwithstanding clause is, in his words, a “stain” on the government’s record and has called for the bill to be repealed.
