A sessions court in Delhi on Monday set aside an order passed by a magistrate court to further investigate Delhi Law and Justice Minister and BJP leader Kapil Mishra over his alleged role in the 2020 riots in Northeast Delhi. “A mere perusal of the impugned order reveals that it suffers from a serious jurisdictional error and is illegal as far as it directs ‘further investigation’ into the ‘first incident’ alleged by the complainant. The Ld ACJM has repeatedly used the word ‘further investigation’, and not once has he mentioned that the order directs the investigation and registration of an FIR regarding the ‘first incident’,” said the court.
