A hiccup has delayed bankruptcy proceedings against Brittany Higgins for another week.
The Federal Court was told former senator Linda Reynolds served a bankruptcy notice on Ms Higgins, but it was handed to her Perth-based lawyer, Carmel Galati.
It was the first time the matter was heard in the Federal Court, and registrar Camille Goucke did not proceed with the case because the notice was not personally served on Ms Higgins.
“I don’t see how we can proceed with the creditor’s petition,” she said.
Ms Goucke said Ms Reynolds’ legal team required an order from the Federal Court to serve the notice to Ms Higgins’ lawyer on her behalf.
She gave Ms Reynolds’ lawyers until Friday to file submissions on the issue of a retrospective deemed service of the bankruptcy notice.
