Labor MLC Stephen Lawrence has claimed neo-Nazis who rallied outside the NSW parliament applied to police only for the matter to be sent to the Supreme Court as a “test case”.

More than 60 members of the neo-Nazi Nationalist Socialist Network rallied outside Macquarie St on Saturday, chanting the Hitler youth slogan “blood and honour” and carrying a banner reading “Abolish the Jewish Lobby”.

The rally sparked widespread condemnation and questions about why the group’s Form 1 application was not opposed.

Under NSW law, organisers of a public assembly must submit a Form 1 to police, which if not opposed affords protesters protections from certain criminal offences, such as trespass and move-on orders.
