NASHVILLE, Tenn. (WSMV) - A Tennessee man on death row has refused to select the manner of death for his execution next month.
Attorneys for Harold “Wayne” Nichols said Tuesday that the state defaulted to lethal injection after the 64-year-old refused to choose between that and the electric chair.
The state’s decision follows a suit filed two weeks ago by Nichols’s lawyers to get access to Tennessee execution records. The legal team argued that the state was violating open records laws by withholding records on execution procedures, which they are hoping to investigate amid allegations of issues with the substance used for lethal injections.
