An almost 70-year-old man accused of raping his wife has been allowed to live with the alleged victim despite a prosecutor claiming dementia symptoms created "too much risk".
In a statement read to the ACT Magistrates Court , the alleged victim said her finances were "at crisis point" without the support of her husband.
The man, who cannot be named to protect the identity of his wife, is facing charges including sexual intercourse without consent, committing an act of indecency without consent and assault occasioning actual bodily harm. They are classified as family violence.
The allegations date back to May 2025, when the man is accused of sexually and physically assaulting the woman.
