A federal court has dealt a blow to chemical corporate giants fighting a class-action lawsuit asserting an increased risk of illness from air pollution in South Charleston in response to their emissions of a carcinogen that has driven up Kanawha County’s cancer risk.
The U.S. Court of Appeals for the Fourth Circuit has denied a request from Union Carbide Corp. and Covestro LLC for it to rehear the case and reconsider its August ruling that revived the lawsuit by overturning a district court decision that granted summary judgment to the companies.
