Derek Rosa is accused of stabbing his mother, Irina Garcia, 46 times on Oct. 12, 2023, and is now charged with first-degree murder, to which he has pleaded not guilty

He allegedly took photos of his mother's corpse after the killing, according to a motion filed by the Miami-Dade State Attorney's Office and obtained by PEOPLE

That motion also claims the killing took place on the eve of Friday, Oct. 13, because of Rosa's alleged affinity for Jason Voorhees, the killer from the Friday the 13th franchise
