BUFFALO, N.Y. — A Depew man is facing charges after a dog died from being locked in a hot car, according to the Erie County Attorney's Office.

Erie County District Attorney Michael Keane says Daniel J. Kowalczyk, 29, is charged with one count of Overdriving, one count of Torturing and one count of Injuring Animals; Failure to Provide Proper Sustenance.

Keane says Cheektowaga Police responded to a parking lot on Walden Ave. Sept. 16 after receiving a report of a dead dog. Investigators say Kowalczyk allegedly left his three-year-old Bulldog, Goon, inside a cage in the rear cargo of the vehicle for over an hour.

Investigators say a necropsy was done on Goon, which determined that he died from "heatstroke due to impaired thermal regulation."

Kowalczyk was released on his own recognizance
