The federal government on Friday filed a notice of its intent to appeal U.S. District Judge Karin J. Immergut’s permanent injunction barring the deployment of National Guard troops from any state to Oregon.
Oregon’s attorneys said the expanded federal appeals court panel convened to consider the U.S. Justice Department’s challenge to a temporary order in the Guard deployment case should instead hear the appeal of Immergut’s permanent injunction.
On Nov. 7, Immergut found that Trump had “exceeded his authority,” in deploying National Guard to Portland against the governor’s wishes, concluding there was no threat of rebellion against U.S. government authority in Portland and officers have not been thwarted from executing federal law amid nightly protests outside Portland’s U.S. Immigra
