The Trump administration has appealed a Nov. 7 decision blocking the deployment of National Guard troops to Portland to the U.S. Ninth Circuit Court of Appeals.
The appeal was filed a week after U.S. District Court Judge Karin Immergut ruled the Trump administration had violated the 10th amendment and Title 10, Section 12406 of the U.S. Code.
That ruling came a week after a three-day hearing where Immergut heard witness testimony about the protests at Portland's ICE facility.
Under Immergut's decision, the 200 Oregon National Guard members remained federalized for two additional weeks, meaning they are still under federal control until Nov. 21.
