Bangladesh has formally requested India to extradite former Prime Minister Sheikh Hasina and ex-Home Minister Asaduzzaman Khan Kamal after they were sentenced to death for their roles in the crackdown on student protests last year. The interim government in Dhaka stated that India is obligated to comply with this request under the existing extradition treaty between the two nations.
The Ministry of Foreign Affairs in Bangladesh emphasized that failing to extradite the convicted individuals would be seen as an "unfriendly" act and a disregard for justice. The International Crimes Tribunal of Bangladesh found Hasina and Khan guilty of "crimes against humanity" during the protests, which led to significant unrest and loss of life.
Sheikh Hasina has been living in India since fleeing Bangladesh in August 2024 amid the protests. The tribunal had previously declared her a fugitive. In December 2024, Bangladesh sent a formal request for her extradition, which India acknowledged but did not comment on further.
Legal experts have pointed out that India has grounds to refuse the extradition request. According to the Extradition Act of 1962 and the India-Bangladesh Extradition Treaty, India can decline extradition if the request is not made in good faith or if the accused might face unfair treatment. The treaty also specifies that certain crimes, including political offenses, may not warrant extradition.
Asif Nazrul, a legal advisor to the Bangladeshi interim government, indicated that they would send another letter to India regarding the extradition. He warned that if India continues to shelter Hasina, it could be viewed as an act of hostility.
The Ministry of External Affairs in India has stated that it remains committed to the best interests of the people of Bangladesh, emphasizing peace, democracy, and stability in the region. The situation remains tense in Bangladesh, with heightened security measures in place amid fears of unrest following the tribunal's verdict.
