HOBBS, N.M. (KFDA) - The state Court of Appeals has affirmed the conviction of the Hobbs woman for leaving her newborn baby in a dumpster in 2022.
Alexis Avila of Hobbs was convicted of attempted first-degree murder and child abuse causing great bodily harm for abandoning her newborn baby in a dumpster.
In 2023, a New Mexico judge sentenced her to 16 years in prison.
Alexis Avila appealed her conviction for intentional or reckless abuse of a child, saying the district court gave a limiting instruction that misdirected the jury.
She also claimed she received ineffective assistance of counsel for not raising an insanity defense.
The appeal claimed she was incapable of forming the deliberate intention to kill her baby at that time.
