A federal district judge on Thursday declined to dismiss the federal assault charges against Rep. LaMonica McIver (Dem., NJ-10), who alleges she is the victim of selective prosecution and that her actions are protected by legislative immunity.

McIver's indictment followed her clash with federal officers during a May 9 congressional oversight visit to Delaney Hall, the Newark immigration detention facility. In a chaotic scene, while the congresswoman attempted to thwart the arrest of Newark Mayor Ras J. Baraka, McIver allegedly slammed her forearm into the body of one law enforcement officer and also allegedly reached out and tried to restrain that officer by forcibly grabbing him, according to the indictment.
